Friendly Reminder: Policies for a Smooth Photoshoot Experience

We want your photoshoot to go as smoothly as possible, and to help ensure everything runs seamlessly, we’ve outlined a few important details below. Please take a moment to review these before your shoot:

Is Your Property Ready?

We understand things can get busy, but please make sure your property is 100% ready for the photoshoot upon the photographer’s arrival. If any last-minute staging/cleaning home preparation takes longer than 15 minutes, the photographer may need to reschedule. The home should be in "parade-ready" condition, as we usually have tight schedules with back-to-back appointments. If the property isn't ready to shoot at appointment time, there will be a $50 fee added for the delay. If it is not ready after 15 minutes of wait time and we need to leave to make sure we get to our next appointment, we reserve the right to invoice for a $125 cancellation/rescheduling fee (instead of the $50 delay fee). The photographer can only wait up to 15 minutes for last-minute adjustments—please have everything set and ready to go, including staging and cleaning, before the shoot begins. We truly appreciate your cooperation!

Shooting "As-Is"

Once the photographer arrives, we’ll capture the property exactly as it is. While we might move a couple of very small items to improve the composition, we won’t handle trash, move furnuture, recycling bins, or any cleaning tasks. If some rooms are not fully prepared by the time we arrive, we won't be able to wait for them to be staged or cleaned. The home should be ready to shoot from the get-go!

Please Make Sure the Space is Unoccupied

To ensure the best photos and to allow the photographer to work without distractions, we kindly ask that no one be present during the photoshoot. This includes agents, owners, tenants, stagers, contractors, and pets. If it's not possible for everyone to leave the property, please let us know in advance. In this case, all people (including agents) will need to stay in one room during the shoot, and pets should be crated or kept in a garage. Photoshoots generally last at least 90 minutes, not including any additional services like Zillow or Matterport 3D tours or video work. Think of it as a great opportunity to grab some coffee, take a walk, or run errands! We are TREC-licensed and background checked for your peace of mind.

Last-minute cancellation?

With the exception or inclement weather, if you cancel your photoshoot appointment time within only 12 hours of the appointment, there will be a $125 cancellation fee. Please let us know as soon as you think the property will not be ready.

OUR AGENT MLS PHOTOSHOOT TERMS OF USE

(SINGLE-USE LICENSING AGREEMENT)

Please inquire for our Short-Term Rental/Vacation/FSBO contract if applicable.

1. All images (including photos and videos) produced by Scott R Hamilton DBA AustinListingPhotos.com are the property by law of Scott R Hamilton DBA AustinListingPhotos.com. We do not transfer any image ownership rights to any other party - including the REALTORS or property owners who paid for the photoshoot services. They are buying a single-use license agreement to use the photos for a listing's duration only.

2. With the payment of said images, the listing agent is granted a license to market their listing using the images for a single-use sale (the listing's duration) or for a lease listing (for the listing's duration only) up to the time it is leased or up to 1 year - whichever comes first. Images may not be used agan for future lease or sale listing. Payment for and download of final edited images constitues an understanding and an agreement to abide by this single-use license agreement.

3. Images are not owned by the REALTOR, HOME OWNER, Agent, Brokerage, MLS (or their parent company) or any other entity. The agent, person, or home owner who orders and/or pays for said images may not sell or transfer said images to any other party for any reason. The images are soley owned by Scott Hamilton D.B.A. AustinListingPhotos.com.

4. Images may be re-purposed or re-licensed by AustinListingPhotos.com during and/or after the listing period for reasons including but not limited to, promotion of AustinListingPhotos.com, promotion of the agent’s business, builder/stager/designer portfolio, licensing to another agent after a listing has expired or sold, or any other reason.

5. Images may not be emailed or transferred in any way by the REALTOR, Agent, or property owner who has paid for the photoshoot to any other agent or to any other party (including home owners, future home owners, brokers, builders, architects, and stagers). Examples of the legitimate use of images would be posting on the agent or REALTOR'S own website, posting to social media for the duration of the listing, publication in advertising for property for sale in periodicals such as newspapers or magazines.

6. Absolutely no future use of the photos (after the current listing's sale, lease, or expiration) is allowed by the homeowners for the sale or lease or promotion of said property without express written consent from Scott Hamilton and AustinListingPhotos.com. A specific license will be made available for purchase. Please let us know what you need.

7. No alterations in any way may be made to the images delivered to client including but not limited to twilight filters, instagram filters, etc. NO AESTHETIC CHANGES TO MY IMAGES ARE ALLOWED WITHOUT SPECIFIC WRITTEN CONSENT FROM SCOTT HAMILTON & AUSTINLISTINGPHOTOS.COM. The only exception to this would be for virtual staging performed by a reputable professional virtual staging company like PadStyler or BoxBrownie. No A.I. virtual staging will be allowed on my images whatsoever.

8. The purchase and download of any photo or video package constitutes agreement by the REALTOR or agent or property owner or any other party ordering the said photoshoot to all of these terms as listed.

IN SUMMARY: With payment and download of final edited images, a single-use license is granted to the listing agent for the duration of a FOR SALE listing or the duration of a LEASE LISTING until it is leased or up to 1 year - whichever comes first. No alterations/photop/object removal may be performed on said images except true virtual staging by a professional virtual staging company. Images may not be re-used without written consent from Scott Hamilton or a new license agreement in place.
